I would, in fact, be gobsmacked.<\/span><\/p>\n<h2 style=\"text-align: center;\"><span style=\"color: #800000;\"><strong><span style=\"font-size: 14pt;\">Isn\u2019t This an Example of \u201cFair Use\u201d?<\/span><\/strong><\/span><\/h2>\n<p><span style=\"font-size: 14pt;\">No.<\/span><\/p>\n<h2 style=\"text-align: center;\"><span style=\"color: #800000;\"><strong><span style=\"font-size: 14pt;\">Uh&#8230;Could You Elaborate on that Answer, Please?<\/span><\/strong><\/span><\/h2>\n<p><span style=\"font-size: 14pt;\">The Internet offers approximately a billion instances of copyright infringement wherein the infringing parties attempt to defend their actions by yelling, \u201cFAIR USE!\u201d<\/span><\/p>\n<h2 style=\"text-align: center;\"><span style=\"color: #800000;\"><strong><span style=\"font-size: 14pt;\">The First Thing You Should Know About \u201cFair Use\u201d<\/span><\/strong><\/span><\/h2>\n<p><span style=\"font-size: 14pt;\">Simply yelling, \u201cFAIR USE!\u201d does not qualify an appropriation of someone else\u2019s copyrighted work under the Fair Use Doctrine.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Individuals who, for example, take a copyrighted audio recording of a hit record, combine it with some sort of graphic and then upload it to YouTube along with the explanation that they are doing so under the umbrella of the Fair Use Doctrine are not protecting themselves against claims of copyright violations.<\/span><\/p>\n<p style=\"text-align: center;\"><a href=\"http:\/\/www.danoday.com\/store\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-19452\" src=\"http:\/\/danoday.com\/blog\/wp-content\/uploads\/2017\/01\/fair-use-on-youtube-copyright-infringement.jpg\" alt=\"using copyrighted music in videos\" width=\"949\" height=\"205\" srcset=\"https:\/\/danoday.com\/blog\/wp-content\/uploads\/2017\/01\/fair-use-on-youtube-copyright-infringement.jpg 949w, https:\/\/danoday.com\/blog\/wp-content\/uploads\/2017\/01\/fair-use-on-youtube-copyright-infringement-300x65.jpg 300w, https:\/\/danoday.com\/blog\/wp-content\/uploads\/2017\/01\/fair-use-on-youtube-copyright-infringement-768x166.jpg 768w\" sizes=\"auto, (max-width: 949px) 100vw, 949px\" \/><\/a><\/p>\n<p><span style=\"color: #800000;\"><strong><span style=\"font-size: 14pt;\">The Second Thing You Should Know About \u201cFair Use\u201d<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\">If the appropriation of a copyrighted work is determined to be covered by the Fair Use Doctrine, that doesn\u2019t mean no copyright infringement occurred.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Quoting attorney and intellectual property expert <span style=\"color: #800000;\"><strong>Julie J. Bisceglia<\/strong><\/span> from <a href=\"http:\/\/danoday.com\/copyright-laws\"><em>THE ULTIMATE, NON-LAWYER&#8217;S GUIDE TO COPYRIGHT INFRINGEMENT IN RADIO COMMERCIALS\u2026And How To Avoid It<\/em><\/a> (without fear of committing a copyright violation, inasmuch as I own the copyright):<br \/>\n<\/span><\/p>\n<blockquote><p><span style=\"font-size: 14pt;\">The Fair Use Doctrine is a way of saying, &#8220;Yeah, there was some copyright infringement but it was so small or it was done for the right kind of purpose that we&#8217;re really not going to hold you liable. We&#8217;re going to allow you to use this little escape hatch that&#8217;s built into the Copyright Act.&#8221;<\/span><\/p><\/blockquote>\n<p><span style=\"font-size: 14pt;\">Bisceglia adds: <\/span><\/p>\n<blockquote><p><span style=\"font-size: 14pt;\">It&#8217;s very, very tricky and very grey. If you have to rely on the Fair Use defense to get yourself out of trouble, you&#8217;re in trouble.<\/span><\/p><\/blockquote>\n<p><span style=\"font-size: 14pt;\">I\u2019m guessing the spot&#8217;s creator believes (and perhaps was counseled) that the commercial qualifies as Fair Use. <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">But one of the four key elements a court looks at is &#8220;the nature and the purpose of the use&#8221;; it needs to be for a &#8220;noble purpose&#8221; \u2014 education, criticism, commentary, etc. <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">It&#8217;s difficult to imagine a court agreeing that &#8220;promoting the sales of radio advertising&#8221; is a &#8220;noble purpose.&#8221;<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(That sound you just heard was that of a few thousand account execs unsubscribing from my <em><a href=\"http:\/\/danoday.com\/free.shtml\">Radio Advertising Letter<\/a>.)<\/em><br \/>\n<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Ironically, I&#8217;d guess that the use of &#8220;Sweet Dreams&#8221; is even less defensible than the use of &#8220;Brown-Eyed Girl,\u201d because \u201cBrown-Eyed Girl\u201d was used to illustrate a point&#8230;<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">&#8230;while ending the spot with the snippet from &#8220;Sweet Dreams&#8221; primarily serves the purpose of&#8230;ending the spot. <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Structurally, it\u2019s a good way to circle back to the opening reference to \u201cthe power of sound.\u201d <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Ending the commercial with a call-back to its opening often is an effective technique. <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">But here, in my opinion, it strengthens the impact of the commercial rather than the impact of the message.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">That may sound contradictory. <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Certainly it\u2019s arcane to the 99.92% of world\u2019s population who aren\u2019t interested in the structural elements of copywriting.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">To me as a writer, \u201cproviding an effective way to end the commercial spot\u201d is a noble purpose.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">But I suspect it would be difficult to find a court that would agree with that to which any good copywriter would readily attest.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Loyal Reader Asks: \u201cI think this is an excellent spot, but isn&#8217;t the use of music to promote Radio advertising a copyright violation?&#8221; \u00a0 Dan Replies: Before I respond, please be sure to read the fine print on my business card.
