{"id":18139,"date":"2015-04-14T00:04:33","date_gmt":"2015-04-14T07:04:33","guid":{"rendered":"http:\/\/danoday.com\/blog\/?p=18139"},"modified":"2015-04-14T22:14:18","modified_gmt":"2015-04-15T05:14:18","slug":"radio-copyright-comments","status":"publish","type":"post","link":"https:\/\/danoday.com\/blog\/2015\/04\/radio-copyright-comments\/","title":{"rendered":"RADIO CONCERT COMMERCIALS &#038; COPYRIGHT LAW"},"content":{"rendered":"<p><span style=\"font-size: 14pt;\">My recent list of a bunch of <a href=\"http:\/\/danoday.com\/blog\/2015\/04\/copyrighted-music-commercials\/\">things that are not allowed in a radio commercial<\/a> without first obtaining permission of the copyright holder seems to have generated a lot of attention. <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Some people asked me to clarify this Q&amp;A:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">Q:\u00a0 Is it legal to air a commercial for a musical performer\u2019s local concert, using recorded examples of his\/her music {without obtaining a license to do so}?<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">Answer: I know you won&#8217;t like this answer, but\u2026No.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><span style=\"color: #000080;\"><strong>Jay Murphy<\/strong><\/span> wrote, referring to the &#8220;using music to advertise a concert&#8221;:<\/span><\/p>\n<blockquote><p><span style=\"font-size: 14pt;\">&#8220;I must confess I was somewhat troubled after reading your letter. No one likes to hear they\u2019re breaking the law. I\u2019ve been in this business long enough to know where the lines are\u2026 or at least I thought I did.\u00a0 All of your examples were obvious to me EXCEPT this one.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">\u201cHere\u2019s the situation. After a conversation with my production director on this very topic, I produced an ad for an upcoming concert event.\u00a0 The ad is being underwritten by the major sponsor and has the full knowledge and blessing of the promoter who\u2019s booking the acts. I do not doubt what you say is true but I need to know then\u2026When exactly, is a concert ad ever legal?&#8221; <\/span><\/p><\/blockquote>\n<p><span style=\"font-size: 14pt;\">As it relates to copyright law, a concert ad is legal when the copyright holder(s) give permission to use the specific pieces of music in the commercial.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">A license doesn\u2019t have to be purchased; it just needs to be granted.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">In the example Jay gives, \u201cThe sponsor has the full knowledge and blessing of the promoter who\u2019s booking the acts.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">If the promoter has been given authority (by the copyright holders) to authorize such usage, there should be no problem.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><span style=\"color: #000080;\"><strong>Steve Macaulay<\/strong><\/span> wrote:<\/span><\/p>\n<blockquote><p><span style=\"font-size: 14pt;\">\u201cMany times in our market, a local musician or their promoter will buy airtime to promote their music and\/or performance.\u00a0They supply original recordings of the artist\u2019s original song.\u00a0I think that constitutes granting permission by the owner of the music.\u201d<\/span><\/p><\/blockquote>\n<p><span style=\"font-size: 14pt;\">If a musician buys airtime to promote his music, which he provides to the radio station for use in the commercial, clearly he is granting the station permission to air his copyrighted material.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">But if the musician owns the copyright to the performance but not to the composition, it\u2019s a mistake to assume that therefore it\u2019s okay to use, in a commercial, whatever recording he gives you.<br \/>\n<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Let\u2019s say <strong>Paul Simon<\/strong> is giving a concert in your market. Paul says to your radio station, \u201cI want the commercials to include <em>The Sounds of Silence<\/em> and also <em>Graceland.\u201d <\/em><\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Sure, Paul, no problem.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">On the other hand, one of the many Paul Simon impersonators is performing in your market, doing a Paul Simon tribute show.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong>\u201cPaal Sighmon\u201d<\/strong> says to your radio station, \u201cI want the commercials to include my impeccable renditions of <em>The Sounds of Silence<\/em> and also <em>Graceland.\u201d<\/em><\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Most likely he owns his own performance rights, so he can grant you a license to use them.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">But if neither Paul Simon nor his representatives have granted a license to use those songs in a commercial? Uh-uh.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">If Paal uses your radio station to advertise his appearance using his renditions of those two songs, without having been granted permission to do so, both Paal and your radio station might well have some legal \u2019splainin\u2019 to do.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><span style=\"color: #000080;\"><strong>Terry Stevens<\/strong> <\/span>wrote:<\/span><\/p>\n<blockquote><p><span style=\"font-size: 14pt;\">&#8220;This one concerns me: <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">&#8220;Air a commercial for a musical performer\u2019s local concert, using recorded examples of his\/her music?
